If you are sending emails to Canadian recipients you should know about Canada’s new anti-spam law that went into effect July 1, 2014. With violation penalties of up to one million Canadian dollars for individuals and 10 million Canadian dollars for organizations, this law includes a number of critical requirements:
- An opt-in confirmation from any Canadian to whom you wish to email unless you have evidence of an established business relationship (transaction) within the past two years
- Retention of all opt-in confirmations
- Even with an opt-in confirmation, all emails to Canadians must include information identifying the sender and the sender’s organization if the email relates to the organization. If the email is sent by individual on behalf of other individuals, all of these names must be identified and included
- Every email to Canadians must include an opt-out mechanism and senders need to assure that anyone opting out no longer receives emails from them
